How Buying a Home in Montana Works

Montana has a few rules and customs that differ from other states. Knowing them ahead of time helps you move faster when the right home appears.

No attorney required

Montana does not require a real estate attorney for residential closings. Title companies handle the settlement process. You can choose to involve an attorney — it is optional, not mandatory.

No state transfer tax

Montana is one of only a handful of states with no real estate transfer tax. When ownership transfers to you, there is no state tax owed on that transaction.

Title company manages escrow

A neutral title company holds your earnest money, down payment and closing funds in escrow until all contract conditions are met. Funds are not released until closing is complete.

Seller typically pays lender's title insurance

Montana is one of the few states where the seller customarily covers lender's title insurance. Owner's title insurance for the buyer is a separate cost and strongly recommended.

Buyer agency agreement required

Since August 2024, Montana buyers must sign a written agency agreement before an agent can show homes on their behalf. This agreement outlines services and how the agent's fee is handled.

Plan for Montana-specific inspections

Beyond a standard inspection, Great Falls buyers should pay close attention to roof condition, HVAC performance, foundation integrity and weatherization. Montana winters are hard on homes.

Additional insurance may be needed

Depending on the property location and lender requirements, buyers may need flood or wildfire insurance on top of standard homeowners coverage. Budget for this before closing.

Closing costs for buyers: 2% to 5%

On a $330,000 home, expect to pay $6,600 to $16,500 at closing. This covers appraisal, loan origination, title work and prepaid items like property taxes and homeowners insurance.

Montana Home Buyer Assistance Programs

The Montana Board of Housing (MBOH) offers several programs to help buyers cover down payments and reduce upfront costs.

Montana defines a first-time home buyer as anyone who has not owned a home in the past three years. Income and purchase price limits apply to all programs below.

15-year repayment

Bond Advantage DPA

Up to $15,000

Down payment and closing cost assistance. Repaid over 15 years with monthly payments at the same fixed rate as your first mortgage. Requires 620+ credit score and $1,000 minimum buyer contribution.

No monthly payments

MBOH Plus 0% Deferred

Up to $15,000

Same dollar limit as Bond Advantage but no monthly payments. Repayment is deferred until you sell, refinance or transfer the property. Income limits are lower for this option.

Annual tax credit

Mortgage Credit Certificate

Up to $2,000/year

A federal tax credit equal to 20% of the mortgage interest you pay each year. Dollar-for-dollar reduction of your federal income tax bill. Can be used alongside the standard deduction.

NeighborWorks Great Falls

NeighborWorks Great Falls provides homebuyer education and additional down payment assistance through the statewide HOME program. Zero-interest loans between $2,500 and $25,000 are available to eligible first-time buyers with incomes at or below 80% of the Cascade County median. A good rule of thumb is to keep your monthly housing payment (including taxes and insurance) at or below 28% of your gross monthly income. However, your comfort level, down payment, and other debts all factor in. We recommend talking with a lender early to get a clear picture before you start touring.
